Note: Each individual member must sign this Release and Waiver of Liability in order to be granted access to Pebble Tossers Inc.?s website search engine.  The signature of any member under the age of 18 must be accompanied by the signature of his or her parent or legal guardian.

 

RELEASE AND WAIVER OF LIABILITY

 

This Release and Waiver of Liability is being granted in favor of Pebble Tossers, Inc., a nonprofit corporation organized under the laws of the State of Georgia, its directors, officers, employees, volunteers, representatives and agents (collectively, ?Pebble Tossers?). I desire to participate in volunteer activities and/or service projects with one or more organizations that I may learn of from Pebble Tossers. In consideration of being granted access to Pebble Tossers? website search engine and database of volunteer opportunities and service projects, I freely agree, on behalf of myself, my executors, administrators, heirs, next of kin, successors and assigns, as follows:

 

1.             Waiver and Release. I waive, release and discharge Pebble Tossers from any and all liability, claims and demands of whatever kind or nature, which arise or may arise from my participation in activities or projects sponsored by organizations I have learned of from Pebble Tossers, including, but not limited to, liability arising from the negligence or fault of Pebble Tossers. I understand and acknowledge that I am discharging Pebble Tossers from any claim that I may have against Pebble Tossers with respect to any bodily injury, illness, death, disability, property damage, property theft or otherwise that may result from my participation in such activities or projects. I acknowledge that Pebble Tossers is NOT responsible for any error, omission, action or failure to act of any organization sponsoring an activity or project that I have learned of from Pebble Tossers.

2.            Assumption of Risk. I understand and acknowledge that my participation in any volunteer activity or service project may involve activities that are hazardous to me. The nature of such activities will depend on the particular activity or project in which I choose to participate but could include, without limitation, contact with animals, lifting and carrying objects that may be heavy or could cause injury if dropped, working in a kitchen, handling food, visiting hospitals or other healthcare facilities, outdoor activities involving exertion and exposure to harsh weather, and transportation to and from activity and project locations. I understand that, by my participation, I may be exposed to many risks and dangers including but not limited to death or serious injury or illness.

3.            Medical Treatment. I hereby release Pebble Tossers from any claim that may arise resulting from any first-aid or other medical treatment rendered to me in connection with my participation in any volunteer activity or service project. I understand that Pebble Tossers has NO obligation to provide medical, health or financial assistance to me under any circumstances.

4.            Media/Photo Release. I understand that I may be photographed or filmed at any of the activities or projects in which I participate. I hereby authorize and give my full consent to Pebble Tossers to copyright and/or publish any and all photographs, videotapes and/or film in which I appear while participating in any such activities or projects. I further agree that Pebble Tossers may transfer, use or cause to be used, these photographs, videotapes or films on its website and for any public displays, publications, commercials, television programs and advertising purposes.

5.            Broad Interpretation. I agree that this Release and Waiver of Liability is to be governed by the laws of the State of Georgia and is intended to be interpreted as broadly as possible under those laws. I agree that if any provision of this Release and Waiver of Liability is held to be invalid, the invalidity of that provision will not affect the continuing enforceability of all other provisions.

PARENT/GUARDIAN WAIVER FOR MINORS (UNDER 18 YEARS OLD)

The undersigned has carefully read this document, fully understands its contents and is signing it voluntarily. I state that I am the parent or guardian having legal responsibility for the above minor (?my child?) and that, acting in that capacity, I have consented to my child?s participation in the activities and projects referred to above. I agree on behalf of my child and myself to the terms of this Release and Waiver of Liability. I further agree to indemnify Pebble Tossers from any and all liability, loss, cost, claim or damage whatsoever resulting from any defect in or lack of capacity to sign this document and release Pebble Tossers. This document binds me and my child, as well as our heirs, executors, administrators and personal representatives.

However, there will be no formal relationship with organizations listed on PTW. PTW allows other organizations to post information regarding their mission and needs. We encourage you to do additional research about organizations of interest before participating in their posted activities. If you are a minor, have a parent or guardian help you navigate the site and select a volunteer opportunity. Additionally, Pebble Tossers, Inc. recommends a parent or guardian accompany a minor when meeting with an organization.
